#143 / The Emoluments Clause

 


The President of the United States is forbidden from taking any present or gift from any foreign state, unless the Congress explicitly authorizes the president to do so. Michael Waldman, the President of the Brennan Center for Justice, has recently reminded us of that, in a blog posting that I am linking right here

Below, let me direct you to the relevant provision in the United States Constitution:

Article I, Section 9, Clause 8:
No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.

Our current president, apparently, doesn't think that he is subject to the restrictions written into our Constitution. What do you think? Check the picture below. Does this look like the kind of "present" that can only be accepted after the Congress signs off?
